Bedtime Story 


Overloaded Japanese Prosecutors 


We shall not into much detail on the origins of criminality for now or the theories pertaining to it.

Suffice to say that Japan criminal justice system is besieged more by white-collar types of crime rather than blue-collar types or drug-related homicides in contrast to the United States.

The other point stated earlier was that Japanese criminal justice system is constrained with extremely limited set of state employed lawyers.

This results in excessive work overload on them.   

So what does this result in?

Perhaps this might instigate more crime once the criminals are aware that the “system is overworked”?

Or perhaps one would expect greater number of acquittals due to lack of enough manpower to strengthen the case for the prosecution?

Or worse, making the prosecution agencies very vulnerable to corruption from the criminal side deliberately weakening the case in their favor?

It is very true that such low number of state advocates in Japan with respect to its population does lead to a significant overload on the prosecuting agencies at all levels – police, state lawyers and judiciary.

Yet rather than falling into the pitfalls that most average societies land up into the Japanese has come up with perhaps the best possible solution if once can call it that.

Japan has come out with brilliant maneuver which perhaps will only work in this civilized country where citizens are strongly encouraged to aid in maintaining public law and order and participate in crime prevention programs.

The approach of Japanese society towards crime is something akin to targeting disease prevention rather than cure to an unprecedented level among the population.

Besides enforcing crime prevention the Japanese prosecutors pushed to the corner because of work load are extremely selective in prosecution.

The study conducted by American scholars of Indiana University and Harvard Law School came up with very interesting figures worth going through.    
    
In the cases of murder in the United States the police arrested 19,000 people for 26,000 murders.

I hope you understand the reasons for discrepancy; it is not uncommon for murder cases to remain unsolved or the perpetrator or at least the accused remaining absconding and thus not been apprehended. 

Of those arrested for these murders in the US 75% were taken for prosecution of whom the courts finally convicted 12,000.

In Japan for 1,300 murders arrest was made of 1,800 people.

This figure may be flummoxing to most but not to me as I shall explain it in the nights to come.
